DEI Crackdown: IBM Pays $17 Million to U.S. Government

IBM has reached a $17 million settlement with the U.S. government to resolve allegations of illegal diversity, equity, and inclusion (DEI) practices in its federal contracting.

IBM has finalized a settlement with the federal government, agreeing to a payment of approximately $17 million to resolve claims related to unlawful diversity, equity, and inclusion (DEI) policies.

The agreement, announced Friday by Acting Attorney General Todd Blanche, addresses Department of Justice (DOJ) allegations that the New York-based technology leader provided misleading information regarding its employment and hiring protocols within federal contracts. Investigators contended that IBM knowingly established demographic targets based on race and sex, which the government identified as discriminatory practices.

Despite the significant financial settlement, IBM has maintained its innocence throughout the proceedings. A company spokesperson emphasized that their workforce strategy remains centered on matching specific skills with client needs rather than adherence to illegal quotas. The formal settlement document explicitly notes that the agreement does not constitute an admission of liability by IBM or a concession by federal authorities regarding the validity of their claims.

The action against IBM is part of a broader shift in federal policy initiated during President Donald Trump’s second term. Since January 2025, the administration has moved aggressively to dismantle DEI infrastructure across both public agencies and private contractors. Todd Blanche highlighted that the DOJ’s Civil Rights Fraud Initiative is specifically designed to prevent government contractors from «repackaging» racial discrimination as corporate diversity. By utilizing the False Claims Act—a Civil War-era statute originally intended to protect the government from fraud—the DOJ has expanded its oversight into the hiring practices of major tech firms and educational institutions.

Under the provisions of the False Claims Act, the federal government possesses the authority to recover up to triple the amount of damages incurred from fraudulent contracts. The settlement underscores a new era of strict accountability for corporate contractors operating under federal mandates. As the Trump administration continues to target diversity-focused hiring goals, the outcome of the IBM case serves as a precedent for how the Department of Justice intends to enforce civil rights laws and protect taxpayer-funded projects from perceived ideological misconduct.
